V čase prírodných katastrof a vojen sa počet tulákov vždy zvýšil a ťažko ich bolo odlíšiť od žobrákov. Proti tuláctvu boli namierené rozličné zákony (napr. Schubpatent Jozefa II. z r. 1790). Ako ťažký priestupok proti verejnej mravnosti sa u cudzincov trestalo vykázaním z krajiny, v opakovaných prípadoch i biľagovaním; u domácich transportom do domovských obcí (poslať ho šupom domov), nútenými prácami, väzením 8–10 dní, u mladistvých núteným pobytom v polepšovniach.
